Laid off, no pay, advice please

Thought I'd throw this question on here as there are far more knowledgeable people than me regarding the situation.

Started new job 24/08, forced to close when we went in to Tier 3 19/10. Found out yesterday that we haven't been 'accepted' on to the JSS closed scheme and will be laid off. Reason given that we started employment after 1st August?? From what I can see as long as you have been on payroll as of 23/09 then you are eligible?
Anyone know anything about this 1st of August rule as I can't find it anywhere? Doesn't seem right to me.

Thanks a lot

JSS now replaced by furlough after tonight's announcement. If you were on payroll prior to midnight on the 30 Oct then your employer can claim it.

Thanks Tangerine77, hopefully they place us on this then? Like I say though, cannot understand why they say we weren't accepted on to the previous one? Fingers crossed anyway, 2nd job I've lost this year without pay so it's getting a bit boring now 😂😂

If he's been laid off it will be signing on in some form, looks like my daughter in same boat. She found one job so sure she will find another until something better turns up. All the best in what you do.

Well it’s the employer who claims under the job support scheme rather than you so ultimately it’s their decision, but it does seem an odd one especially as they only have to pay 5% of your wages.

To further complicate matters the furlough scheme, which was supposed to have ended last night, is being extended (possibly only starting from Thursday) because of the new lockdown. As that’s only just been announced your employers wouldn’t have been aware when they made the decision to lay you off so I’d speak to them again.

RC:
I can't give you any advice on your actual question but if you are fit and able Royal Mail are recruiting temps for Christmas.

Yeh I believe so insider, I'll have a look at that.
I just wandered about the reason they have being that I wasn't employed on 1st of August but I can't find that info anywhere? As long as you're on the payroll by 23rd September then you're eligible surely?

Employees you can claim for

You can claim for employees on any type of contract (including zero-hours and temporary contracts) who:

  • were employed by you on 23 September 2020
  • you made a PAYE Real Time Information (RTI) submission notifying payment to HMRC, any time from 6 April 2019 up to 23 September 2020
  • are working at least 20% of their usual hours across the claim period - as an employer you will decide what activities count as work
  • you have agreed and implemented a JSS Open temporary working agreement covering at least 7 consecutive calendar days
An individual is an employee for the purposes of this scheme if you treat them as an employee for Income Tax purposes, regardless of how you treat them for National Insurance purposes.

You can also check how eligibility is affected if you’re claiming for employees with different employment conditions.

Thanks TAM, that's the information I'm aware of as well, which is baffling me as to WHY they are saying I (we) are ineligible having began work after 1st of August? I'm a venue manager personally so this is something which I fighting for on behalf of my team as well, hence getting us much info from as many sources as possible.
The business falls under JSS Closed, however they are telling us our application has been rejected (even though other venues in the area have been accepted) and that we are ineligible having begun after 1st August?

Thanks all

If you have been made redundant, if you have enough NI contributions over the last 2-3 years, then New Style Jobseekers Allowance can be claimed for 6 months. You could also be eligible for Universal Credit. Go to GOV.UK and search for Jobseekers Allowance and check the eligibility questions.

Don’t know if you are sorted but Martin Lewis just put this out on Twitter - might help and hope you get sorted regardless 👍

“CONFIRMED: If you've been made redundant, you can be rehired and furloughed by your employer if you were employed as of 23 Sept, and on the payroll on or before 30 Oct.

It won't work for many, but many be worth asking for some. “
